This document sets out the general terms and conditions (the “Terms”) governing the use of the Piacere Lavazza application owned by Luigi Lavazza S.p.A.. The application allows the user to access all the contents related to Lavazza, its brand and products and to access to the features and interaction of the Lavazza A Modo Mio Voicy – Alexa BuiltIn coffee machine.
Using the Application or signing in by the User will be deemed as acceptance of these Terms. Before using the Application, it is required to the User to read these Terms and any subsequent amendments or variations carefully.
If the User does not intend to accept these Terms and/or any other note, legal notice, information published or referred to herein, he will not be able to use the Application or the relative features.
Lavazza retains the right to vary the contents of these Terms, accessible on the Piacere Lavazza Application. We therefore invite the Users to periodically consult the Piacere Lavazza App to check for any updates or changes. Any changes will be effective after the publication.
1. Definitions
"Lavazza Account": the personal access credentials of the User necessary to access the Piacere Lavazza Application
"Piacere Lavazza Application" or “APP”: the mobile application owned by Lavazza made available for download on mobile devices through the Google Play Store and Apple Store platforms.
"Contents": all the images, photos, videos, texts, audio, trademarks, logos owned by Lavazza and distributed through the Piacere Lavazza App

"Terms": the terms and conditions of use related to the Piacere Lavazza Application
"User(s)": any individual who accesses and uses the Piacere Lavazza Application without pursuing commercial or professional purposes
2. Purpose of the application and limits of use
Using the APP, the User may:
a. access and use the Contents and remain updated on all the news of Lavazza;
b. pair and activate its Lavazza A Modo Mio Voicy machine and access to the related connectivity features;
c. access and participate in the initiatives that Lavazza reserves for its Users;
Lavazza retains the right to change at its own discretion, at any time, the graphic interface of the Piacere Lavazza Application, the Contents and their organisation, as well as any other aspect of the App. The Users will be promptly informed about such variations.
Lavazza may discontinue, modify or correct any errors or omissions in any section of the Piacere Lavazza Application, suspend or interrupt any function of the APP, including the availability of any of its functions, at any time and without notice.
Lavazza has no obligation to monitor the Piacere Lavazza Application or the contents sent by Users. However, Lavazza reserves the right to (i) delete, suspend or modify the contents of the Piacere Lavazza Application at its own exclusive discretion and at any time, including, purely by way of example, the User Content, without any obligation to give prior notice and for any reason whatsoever, (including, purely by way of example, the receipt of complaints or accusations from third parties or authorities relating to the use of such User content, or if we consider that the User has breached these Terms), and (ii) to delete, suspend or block the User content from the Piacere Lavazza Application. Lavazza also reserves the right to access, read, store and disclose information (except for any personal information or data) submitted or available on the App as it reasonably believes to be necessary to (i) comply with applicable laws, regulations, legal processes or governmental requests, (ii) enforce these Terms, including investigating potential breaches of them, (iii) detect, prevent or otherwise address fraud or technical or security issues, (iv) respond to user support requests or (v) protect the rights, property or safety of Lavazza, its users and the public
The User may access any section or content of the Piacere Lavazza Application according to his level of use and in compliance with these Terms.
Use of the Application requires access to the Internet and/or a smartphone or tablet connection, the costs of which are borne entirely by the User. The Application is intended exclusively for personal use and is provided and distributed for use on Italian territory only.
The User undertakes to use the services and contents of the Application in compliance with their characteristics and technical specifications and in accordance with the provisions of these Terms and the applicable laws, regulations and customs.
3. Registration and Lavazza Account
In order to be able to use the Contents and the features of the Piacere Lavazza Application the User is required to proceed with the registration of his own Lavazza Account. In this case it will be necessary to complete the registration process by providing us with complete and accurate information, as declared on the registration form. You will also need to identify a password. The User will remain responsible for keeping and maintaining the credentials of his Lavazza Account.
Users who already have a Lavazza Account may use their credentials within the relevant Log-in section.
4. Communications and Notifications
The Application may send to Users push notifications as part of its normal running operation. The User can deactivate the push notifications from the settings of his smartphone/tablet.
Within the Profile Section, the User will be able to check at any time all the notifications sent by Lavazza, as well as to access a summary of his activities.
5. Exclusion of guarantee
The Application is supplied "as is" and "as available" and Lavazza does not provide any explicit or implicit guarantee in relation to the Piacere Lavazza Application, nor does it provide any guarantee that the same will be able to satisfy the requirements of the Users or that it will never have interruptions or be free of errors or that it will be free of viruses or bugs.
Lavazza will endeavour to ensure that the Piacere Lavazza App is available 24 hours a day without interruption, but cannot in any way be held responsible if, for any reason, the Piacere Lavazza App is not accessible and/or operational at any time or for any period. Access to the Piacere Lavazza App may be suspended temporarily and without notice in the event of system failure, maintenance, repairs or for reasons completely beyond Lavazza's control or for events of force majeure.
6. Limitation of Liability
Lavazza cannot be held liable to the User, except in the case provided by the applicable law, for disservices or malfunctions connected with the use of the internet network outside of its own control or that of its suppliers.
Furthermore, Lavazza will not be responsible for any damage, loss or costs suffered by the User as a result of failure to execute this Terms.
Lavazza accepts no responsibility for any fraudulent or illegal use which may be made by third parties of credit cards and other means of payment.
Lavazza will not be liable for any loss of commercial opportunity and any other loss, including indirect loss, which may be suffered by the User which is not a direct consequence of breach of contract by Lavazza or incorrect or unsuitable use of the Application by Users or third parties.
7. Copyright and Intellectual Property
Lavazza is the exclusive owner of the Contents of the Piacere Lavazza Application, including by way of example but not limited to the texts, documents, images, videos, logos, photographs, layout of the pages, design, know-how and products, which are covered by copyright, trademarks, patents and/or other industrial and intellectual property rights recognised by law.
None of the content of the Piacere Lavazza Application may be considered or interpreted as being licensed or as being the object of any other right of use by the Users or any third parties.
Users are authorised to download, view or print contents of the App for exclusively personal purposes and of a non-commercial nature, in such a way as not to cause any damage to the industrial and intellectual property rights of Lavazza in relation to the said contents of the Lavazza Pleasure App and in compliance with these Terms.
While using the Piacere Lavazza Application, the User may not, without the prior authorisation of Lavazza
- publish the Contents displayed on the Piacere Lavazza App on its own websites or those of third parties;
- sell, licence or sub-licence the Contents present on the App;
- reproduce, duplicate, transmit or distribute the Content for commercial purposes.
The User is obliged to use the Piacere Lavazza Application and the services offered therein in strict and constant compliance with the law, public order and morality.
In any case, the User must use the Piacere Lavazza Application in such a way as not to cause damage or malfunctioning relative to the availability and use of the Materials and, in general, to its functions.
In this sense, any use aimed at copying, filing, sending, transmitting or publishing any material containing or connected to any computer virus, spyware, malware or in general any content or application aimed at damaging the Piacere Lavazza Application is prohibited.
All uses aimed at illegal, fraudulent, or harmful conduct or in any case relating to illegal, fraudulent or harmful activities or purposes are also prohibited.
8. Privacy
Personal data shall be collected and processed in accordance with the Privacy Policy, which can be viewed on the website
9. Applicable law and competent court
The Terms are subject to the English Law.
Any dispute relating to the application, execution and interpretation of these Terms shall be settled by the competent courts of the place of residence of the Users.

10. Final Provisions
Force Majeure
Lavazza may not be held responsible for failure to fulfil, or delay in fulfilling, its obligations due to circumstances beyond Lavazza's reasonable control due to force majeure events or, in any case, to unforeseen and unforeseeable events which are beyond its control.
Lavazza's fulfilment of its obligations will be understood to be suspended for the period in which events of force majeure occur.
Lavazza will take any action within its power in order to identify solutions which will allow the correct fulfilment of its obligations despite the persistence of force majeure events.
Links to third party sites
The Piacere Lavazza App may contain links to third party sites/applications. Lavazza does not exercise any control over them and, therefore, is in no way responsible for the contents of these sites/applications.
Some of these links may refer to third party sites/applications which provide services through the Piacere Lavazza app. In these cases, the general conditions for use of the Piacere Lavazza app/application and for use of the service provided by the third party will apply to the individual services, for which Lavazza accepts no responsibility.
Violations
Failure to comply with these Terms constitutes a breach of the conditions of use of the Site and therefore permits Lavazza to resort to the remedies it deems most appropriate to deal with such a breach, including: inhibition of access to the Site, suspension of the account and access to the registered area and finally recourse to the Judicial Authorities.
